Privacy contact: Kelly Swingler

We handle personal information under the UK General Data Protection Regulation and the Data Protection Act 2018, as amended.
Information we collect
Depending on how you interact with us, we may collect your name, email address, telephone number, postal and billing addresses, job title, organisation, professional experience and qualifications.
We may also collect enquiries and correspondence; applications and booking details; purchases, invoices and payment status; attendance, learning progress, assessment submissions, feedback and certification records; community contributions; and your communication preferences and consent records.
When you use the website, our systems may collect technical information such as your IP address, browser and device information, pages visited, referring website and access times. The information collected through optional tracking depends on the tools used and your choices.
Our website and associated website services are provided through Squarespace. Some payments are processed through Stripe. These providers process the information needed to provide their services, including payment information where relevant. Their privacy notices explain their own processing: https://www.squarespace.com/privacy and https://stripe.com/gb/privacy.
Where information comes from.
We usually collect information directly from you through website forms, email, bookings, purchases, training activities and community participation. We also receive relevant transaction and account information from the service providers we use.
If an employer or another organisation books training for you, it may give us your name, work contact details and booking information. If an assessor or training participant provides feedback about your work, we may receive that feedback as part of your assessment. We explain any additional sources and uses when relevant.
How we use information and our lawful bases.
Enquiries and applications: we use your details to respond and discuss suitable services. Our basis is taking steps at your request before entering a contract, or our legitimate interest in responding to general business enquiries.
Purchases and participation: we use information to process bookings, provide resources and training, manage accounts and memberships, communicate service information and carry out agreed assessments. Our basis is performance of our contract with you. Where your employer holds the contract, our basis is our legitimate interest in delivering the booked service and administering participation.
Quality and professional records: we use relevant attendance, assessment and feedback information to maintain training standards, administer certificates and respond to verification requests. Our basis is contract where this is part of the agreed service, or our legitimate interest in maintaining accurate professional records and improving delivery.
Business administration and security: we use necessary information to manage suppliers, protect our systems, prevent misuse and handle complaints or legal claims. Our basis is our legitimate interest in running and protecting our business. We consider your rights and use only information proportionate to these purposes.
Legal obligations: we use and retain information where necessary to meet applicable accounting, tax and other legal obligations.
Marketing: we use your contact details to send newsletters and information about training, events and resources where you have opted in. Our basis is consent. You can unsubscribe using the link in our emails or contact us at any time. Administrative messages about an existing purchase or programme are separate from marketing.
Testimonials and promotional material: we obtain your consent before publishing an identifiable testimonial, photograph or participant contribution for marketing. We explain where and how it will be used.
Optional website tracking: where we use consent-based analytics or advertising tools, our basis is consent. Essential security and operational processing relies on our legitimate interest in providing a secure, working website.
Health information and other sensitive information.
Because our work concerns burnout, you may choose to tell us about your health, disability or support needs. Health information is special category personal data and receives additional protection. Please do not include unnecessary medical details in a general enquiry or share identifiable information about clients or other people.
Where we need health information to arrange accessibility support or another clearly specified service, we explain what is needed, who will see it and how long it will be kept, and obtain your explicit consent before using it. Our Article 6 basis is consent and our Article 9 condition is explicit consent, unless we identify and explain another applicable legal basis and condition.
You can withdraw this consent by contacting us. Withdrawal does not affect lawful use before withdrawal. We will explain any practical effect on the support we can provide and discuss alternatives. Sharing health information in a message does not automatically authorise us to use it for other purposes.
Training recordings assessments and community participation.
Where a session or assessment is to be recorded, we provide information beforehand about its purpose, who can access it and its retention period. We explain the lawful basis and obtain any necessary consent, including explicit consent where a recording intentionally includes health information.
Assessment recordings, written reflections and coachee feedback are used for the assessment and related quality assurance described when they are collected. They are not used for marketing without separate consent. Participants must obtain appropriate permission from anyone appearing in their submitted recording and avoid unnecessary sensitive information.
Other participants may see your name, image, voice and contributions during group sessions or within community spaces. Please consider what you share. We ask participants to respect confidentiality, but cannot guarantee how another participant handles information they see or hear.
Where an employer sponsors participation, we explain any reporting arrangement before sharing attendance, completion or assessment outcomes. Personal disclosures and health information are not included in routine sponsor reports.
Who we share information with.
We do not sell your personal information or pass it to any other businesses for their own marketing. We use Squarespace to provide our website and associated services, and Stripe to process some payments. Information is processed by these providers, and their authorised service providers, as needed to operate those services.
Squarespace processes website, form, customer and mailing-list information where those features are used. Stripe processes payment and transaction information where a payment is made through Stripe. Each provider may also process information as an independent controller for purposes described in its own privacy notice, such as security, fraud prevention or legal compliance.
We do not otherwise routinely disclose personal information to other organisations. We may disclose information if legally required, for example in response to a valid request from an authority.
International transfers.
Squarespace and Stripe operate internationally, and information may be processed outside the United Kingdom, including in the United States. Their data protection arrangements include mechanisms for international transfers, such as applicable adequacy arrangements and contractual safeguards.
For information about their international processing, see https://www.squarespace.com/privacy, https://www.squarespace.com/dpa and https://stripe.com/gb/privacy. You can also contact us at hello@kellyswingler.com for information about the safeguards applicable to your information and how to obtain a copy.
How long we keep information.
We keep personal information only for as long as needed for the purpose for which it was collected, including relevant legal, accounting and record-keeping requirements. Our retention arrangements are:
Enquiries that do not lead to a purchase: for as long as you remain on our mailing list.
Booking, contract and financial records: For up to three years in accordance with our banking and accountancy records.
Training, assessment and certification records: 24 months.
Session and assessment recordings: 12 months
Health and accessibility information: for the duration of the contract only.
We delete your mailing-list details immediately when you unsubscribe. We do not keep a separate marketing suppression list. If you are also a customer or training participant, unsubscribing does not delete separate booking, financial or training records that we still need for the purposes described in this policy.
We may keep relevant records longer where necessary for an unresolved complaint, legal claim or legal obligation. Information is then securely deleted or anonymised.

This website collects personal information to power our site analytics, including information about your browser, network and device; web pages you visited prior to coming to this website; and your IP address.
This information may also include details about your use of this website, including clicks, internal links, pages visited, scrolling, searches and timestamps.
We provide this information to Squarespace, our website analytics provider, to learn about site traffic and activity. We ask for consent before placing cookies or using tracking technologies that require it. You can change your choices through. Declining optional tracking does not prevent you from accessing the core website, although some optional embedded features may remain disabled.
Keeping information secure.
We use appropriate technical and organisational measures to protect information, including access controls and secure systems. Access is limited to people who need it for their work. No internet transmission or storage system can be guaranteed completely secure.
Your rights.
Depending on the circumstances, you can ask to access your personal information, correct inaccurate information, delete information, restrict its use or receive information you have provided in a portable format. You can also withdraw consent at any time where our use relies on consent.
Your right to object: you can object to processing based on legitimate interests on grounds relating to your situation. You have an absolute right to object to use of your information for direct marketing, including related profiling.
To exercise your rights, email hello@kellyswingler.com. We may need to verify your identity. We normally respond within one month, subject to the extensions or pauses permitted by law. These rights are subject to legal conditions and exceptions; we explain any restriction that applies.
Providing contact, booking and payment information may be necessary to enter into or fulfil a contract. If you do not provide required information, we may be unable to process the booking or deliver the service. Marketing consent is optional.
We do not make decisions about you based solely on automated processing that have legal or similarly significant effects. If such processing is used, replace this sentence with details of the processing, effects and applicable rights.
Questions and complaints.
Please contact hello@kellyswingler.com if you have questions or a concern about how we handle your information. You can also complain to the Information Commissioner’s Office, the UK data protection regulator, at https://ico.org.uk/make-a-complaint/ or by calling 0303 123 1113.
